Lost Wages

Obtaining this compensation is important when an injury forces you to take time off from work. Being off work may be next to impossible if you were already strapped for cash. You have the right to ask for lost wages if you are granted a workers' compensation claim.

When must I file?

You have a limited time to file a claim for benefits. Typically, a worker must report an incident to their employer within thirty days of its occurrence. We can help you follow the appropriate procedures in order to pursue your claim properly, including dealing with your employer or your employer's insurance adjustor.

If you do not file a claim with the Virginia Workers Compensation Commission (which is NOT filing a claim with the insurance company), the insurance company can stop paying you at any time for no reason at all. They can pay you late, or infrequently, and still there is nothing you can do. If two years pass, they will cut your benefits off completely because you never filed a claim for benefits with the Commission and you will then have no more benefits. If a claim is filed with the commission, the commission will give you an award order which will protect your rights, and then the insurance company can not cut your benefits off unless it is a valid reason. You will also have recourse if they pay late. They may have to give you a 20% late payment penalty.

How much can I get?

Each person's case and the compensation they receive are unique. A workers' compensation case is very factually specific. Generally, if you are granted workers' compensation, you are entitled to two-thirds of your average weekly pay. This includes any bonus, per diem, overtime and other forms of pay.

Payments for lost wages are not permanent. They may be terminated if the doctor finds you are capable of returning to full duty or light duty. Lost wages are only recoverable for up to five hundred weeks.
