What should I tell my insurance adjuster?

Below are some initial questions many clients have when they first contact Injured Workers’ Law Firm. The questions below may address initial concerns you may have. If you don’t find the answers here, you should contact us for answers to questions specific to your case. The consultation is free.

Q: What should I tell my insurance adjuster the first time I speak with him/her?

A: The workers compensation insurance adjustor will call you requesting a recorded statement. A very common mistake is that people assume that all injuries that occur at work are covered under workers compensation. This is definitely not true. The insurance adjustor is trying to save their company money and will interrogate you and lead your answers to reach this goal.

If you have been in a workers compensation accident, you will be interviewed by an adjustor from your employers’ workers compensation insurance company. The adjustor is trying to minimize the amount of money that their company will pay. Follow this tip sheet to make sure you do not jeopardize your claim during the initial phone interview.

Most insurance adjustors are highly trained adversaries, although most people would never think this, at least not in the beginning of the claims process. Now, most people understand that the insurance company’s job is to make money and it does this by settling claims for less than the claim is worth, denying claims, or delaying claims. Yet, most people are unaware of how sophisticated, yet simple, the methods the carrier will utilize to help it accomplish this goal. Here are some questions that often will make the insurance company uncomfortable. No, the carriers don’t like it when you ask these questions because they either cannot answer the question or worse, they don’t want you to have the answer.

I have written two reports on how to talk to insurance adjustors. Tough Questions – Questions the Insurance Adjustors Don’t Want You To Ask, Dos and Dont’s Checklist – Talking With An Insurance Adjustor. [PDF]
