3rd Party Personal Injury Claims – An injured worker cannot sue his employer. However, an injured worker can file a workers compensation claim against his

employer while simultaneously pursuing a 3rd party personal injury claim. Some examples would be:

 

(a)    Medical malpractice claim against the treating physician;

 

(b)   Personal injury claim against a non-coworker for an auto accident, equipment maintenance, delivery of materials, or premise liability; and

 

(c)    Products liability claim against a manufacturer for defective equipment.
