I talk to a lot of injured workers in Virginia. Some I represent and some I do not represent. There seems to be a misconception out there among Virginians that the Virginia Workers’ Compensation Commission (VWC) is advocating for them and is there to protect their rights as an injured worker. This is not the case! The Virginia Workers’ Compensation Commission is an impartial entity, a judge if you will, who hears both sides of the claim (the injured worker’s side and the workers’ compensation insurance carrier’s side) and then makes a determination on the approval or denial of benefits bases on the current Virginia laws. The folks at the VWC are not for or against injured workers. They are simply there to appropriately apply Virginia law as it relates to workers’ compensation injuries.
