First of all, I just need to tell you that this is common. DO NOT GIVE UP! I get so many calls from injured workers asking “why is the insurance adjuster ignoring me”? Or, when they finally do get to talk to the adjuster, they were not treated very kindly
Don’t let Frustration get the best of you! This is a tactic. Yes, insurance companies deal with a large volume of people, and not all adjusters are bad, but you need to understand that they have a job to do. It is very sad, but if you have read my book, “Ultimate Guide to Workers’ Compensation in Virginia”, then you know that this is simply a tactic the insurance company uses to deter injured workers from pursuing their benefits. If the adjuster or the case manager can slow things down or get you upset or frustrated to the point that you give up on your claim; it keeps money in their pocket.
Do Not Give Up
I tell people all the time, DO NOT GIVE UP! Even if you have to call every day and be a pain in the neck to get results then that is what you should do. The Virginia workers compensation system is flawed in many ways so it is always best to be your own advocate and be proactive when it comes to the benefits you are entitled to.
I know it can be frustrating to feel like you are constantly calling and getting nowhere but sometimes if you let the adjuster know you are not going to give up or go away, they might be a little more inclined to communicate with you more quickly.
File The Claim for Benefits
Another way to let the insurance company know that you are serious about pursuing your claim is to file the Claim for Benefits with the Virginia Workers Compensation Commission. Once you file this formal request for your benefits, the Commission will then notify the insurance company. If the insurance company still refuses to respond then the Commission will step in and schedule a formal hearing for your claim.
Contact a Virginia Workers Compensation Attorney
If my office is representing you, then we handle communications with the adjusters for our clients and it is not uncommon for the Paralegals and Legal Assistants in my office to call adjusters repeatedly and bug them until they address the situation for our client. If you are not currently represented by an attorney, then you are free to call the adjuster directly. However, if the insurance company is not responding to you and your benefits are not being paid, you need to consult an experienced Virginia workers compensation lawyer immediately.
