Workers’ Comp Benefits for Medical Treatment in Virginia
The Virginia Workers’ Compensation Act provides a comprehensive legal remedy to people who were injured or made ill while on the job. Injured workers are entitled to no-fault coverage for their medical treatment. Virginia law holds an employer (workers’ comp insurer) responsible for an employee’s medical care if:
- The medical treatment is causally related to the work accident;
- The medical treatment is reasonable and necessary for the employee’s recovery; and
- The treatment is with the authorized workers compensation treating physician.
Should a dispute arise over medical care, an injured worker has the burden of proving a link between the treatment and their workplace accident/illness and that such treatment was reasonable and necessary given their condition. As long as the employee satisfies these criteria, the medical care should be covered under Virginia’s workers’ comp insurance.
Duration of Medical Treatment is Not Limited by Virginia Law
Virginia workers’ comp laws require an injured employee to see a doctor without reasonable delay. You should always get immediate medical attention after a workplace accident. However, the law does not put a defined duration on how long medical care can be covered by workers’ comp. As long as treatment is deemed reasonable and necessary, a workers’ comp provider is liable unless the employee has agreed to fully settle the claim. As long as you have not settled your claim and the authorized workers compensation treating physician says that the treatment is reasonable, necessary and directly related to the work accident, your medical benefits are for your lifetime.
