Permanent Partial Disability (PPD) Benefits in Virginia
The Virginia Workers’ Compensation Act allows injured workers to obtain permanent partial disability (PPD) benefits if they suffered amputation or functional loss of a scheduled body part. You can find the schedule under Code of Virginia § 65.2-503. As a general matter, PPD benefits will be only awarded once medical treatment has ended. In other words, a doctor must certify that an injured worker has received maximum medical improvement (MMI) before they can file for PPD benefits.
To get a PPD award in Virginia, an injured worker should obtain something called a functional capacity evaluation (FCE) from a qualified medical professional. In most cases, an FCE is performed by a licensed physical therapist. Essentially, this evaluation is used to determine the extent of a worker’s remaining impairment after they have reached the point of maximum medical improvement. Then, your workers’ compensation treating physician must approve the FCE rating. With a properly conducted FCE, you will be able to obtain a PPD rating and payment for your impairment(s). You can’t get permanent partial disability benefits while you are receiving temporary total disability benefits (your wage loss benefits).
