Virginia Workers’ Comp Laws: Time Loss Compensation
Under the Virginia Workers’ Compensation Act, employees are entitled to no-fault work injury insurance coverage. If you are hurt on the job, you are entitled to time loss compensation. Also commonly called wage loss compensation, the Virginia Workers’ Compensation Commission (VWC) officially calls time loss compensation temporary total disability (TTD) benefits.
In Virginia, time loss/wage loss compensation is calculated based on an employee’s Average Weekly Wage (AWW) which is your gross earnings for the 52 weeks prior to the accident. Overtime and bonuses are included. Put another way, the VWC will determine your benefits based on your ordinary earnings. TTD benefits are paid at two-thirds of a workers’ Average Weekly Wage. Benefits can be paid out until a worker is medically cleared to return to the job—subject to a maximum duration of 500 weeks.
Notably, Virginia law states that time loss benefits only kick in after seven days. To recover workers’ comp benefits for lost wages, you must have medical evidence that supports that you cannot work for at least one week. If your injury, illness, or impairment keeps you out of work for more than 21 days, you can seek reimbursement for the initial seven days of lost wages.
