Virginia Workers’ Comp: Car Accident Claims
Under the Virginia Workers’ Compensation Act, companies, organizations, and agencies are required to provide no-fault work injury insurance coverage to virtually all employees in the Commonwealth. If you are hurt while on the job, then you are entitled to workers’ compensation benefits. In some cases, there are questions about what it means to be “at work”—indeed, this is often an issue with job-related accidents.
In Virginia, a worker does not have to be on their employer’s actual premises to be covered by workers’ compensation insurance. Instead, workers’ comp insurance applies when you are acting within the course and scope of your job, in the furtherance of your employer’s interests. In effect, this means that if you are driving as part of your job duties, you can seek workers’ comp benefits for an accident. To be clear, filing a workers’ compensation claim does not prevent you from bringing a personal injury directly against a reckless driver or other negligent defendant.
Note: Your daily commute from your home is not covered by workers’ comp in Virginia. However, a car accident that happens during job-related overnight travel (a business trip) is generally covered.
