Workers’ Comp Benefits for Job-Related Depression in Virginia
Under the Virginia Workers’ Compensation Act, an employee may be entitled to benefits for depression, anxiety, or another similar psychological condition if they can prove that their mental health issue is linked to their workplace injury. Unfortunately, benefits for work-related depression claims cannot be recovered in every case. Virginia law mandates that compensation for a psychological condition—such as depression or anxiety—will only be paid if the worker has also suffered a physical injury and the mental health issue can be linked to the physical trauma
In other words, you cannot bring a workers’ comp claim in Virginia to get compensation for depression unless you first file a claim related to a physical injury. If you did suffer a physical injury or develop an occupational disease and you are suffering depression/anxiety related to that incident, then you can seek workers’ comp benefits for that mental health impairment. There are a few exceptions. For example, effective July 1, 2020, a new law provides that post-traumatic stress disorder incurred by a law-enforcement officer or firefighter is compensable under the Virginia Workers’ Compensation Act under certain specific facts.
