Virginia Workers’ Comp: Catastrophic Injuries
Paralysis is among the most difficult, debilitating injuries that any person can endure. Broadly defined, paralysis is the loss or severe impairment of the ability to move and/or feel anything in a particular part of the body. Monoplegia is paralysis of a single limb or muscle group. Paraplegia is the paralysis of the lower half of the body. Quadriplegia is the paralysis of all four limbs. Most often, paralysis is a condition related to underlying spinal cord damage.
Workers who have suffered paralysis injuries and related impairments are protected by Virginia law. The Virginia Workers’ Compensation Act mandates that all employers in the Commonwealth with three or more regular employees (full-time or part-time) must provide no-fault workers’ comp insurance coverage. Paraplegia and quadriplegia are catastrophic injuries. Under Virginia law, a worker who sustained a catastrophic injury may be entitled to:
- Coverage for all emergency medical expenses;
- Coverage for long-term care, including physical therapy and home health services; and
- Lifetime weekly compensation.
